Privacy Policy

Plain-language summary: We collect only the information needed to run your listing and deliver services. We do not sell your personal information. We use Stripe for payments (we never see your card number). You can request deletion of your data at any time. If you are a Quebec resident, you have additional rights under Quebec Law 25.

1. Who This Policy Applies To

This Privacy Policy applies to all users of ownerlisted.ca ("Platform"), including: sellers who create accounts and submit listings, buyers who submit inquiries, visitors who browse the Platform, and individuals who submit their contact information through our lead capture forms.

It describes how OwnerListed ("we," "us," "our") collects, uses, discloses, and protects your personal information in compliance with the following applicable Canadian privacy laws:

Federal Personal Information Protection and Electronic Documents Act (PIPEDA), SC 2000, c. 5 — applies to OwnerListed's commercial activities across Canada, including in provinces without substantially similar provincial legislation.
Alberta Personal Information Protection Act (PIPA), SA 2003, c. P-6.5 — applies to OwnerListed's collection and use of personal information about Alberta residents. Alberta is a "substantially similar" province under PIPEDA.
British Columbia Personal Information Protection Act (PIPA), SBC 2003, c. 63 — applies to OwnerListed's collection and use of personal information about BC residents. BC is a "substantially similar" province under PIPEDA.
Quebec Act Respecting the Protection of Personal Information in the Private Sector (Law 25 / formerly Bill 64), CQLR c. P-39.1 as amended by SQ 2021, c. 25 — applies to OwnerListed's collection and use of personal information about Quebec residents. Quebec is a "substantially similar" province under PIPEDA. Law 25 requirements that exceed PIPEDA apply to Quebec residents.
All Provinces & Territories Canada's Anti-Spam Legislation (CASL), SC 2010, c. 23 — applies to all commercial electronic messages sent by OwnerListed to any Canadian email address.

In the event of a conflict between these laws and this Policy, the stricter applicable law governs for residents of that province.

2. Information We Collect

All payment processing is handled by Stripe, Inc. OwnerListed never sees, receives, or stores your credit card number, expiry date, or CVV. Stripe's privacy policy is available at stripe.com/en-ca/privacy. We receive from Stripe only a transaction confirmation and the last 4 digits of the card used.

3. How We Use Your Information

We use your personal information only for the following purposes, and only to the extent necessary for each purpose:

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

We do not use your personal information for automated decision-making that produces legal or similarly significant effects on you.

4. When We Share Your Information

4.1 With Buyers

Your listing displays your property address and asking price publicly. Your personal contact information (name, phone, email) is shared with prospective buyers only through the Platform's inquiry form — buyers cannot see your direct contact details until they submit an inquiry, which is forwarded to you.

4.2 With Service Providers

To deliver add-on services, we may share your property address, contact details, and access instructions with third-party contractors (photographers, sign delivery crews, open house agents). These contractors are required to use your information only to deliver the booked service and may not use it for any other purpose.

We may disclose your information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, property, or safety of OwnerListed, our users, or the public. Where legally permitted, we will notify you before making such a disclosure.

4.5 Business Transfers

If OwnerListed is acquired, merged, or sells substantially all of its assets, your personal information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on the Platform at least 30 days before your information becomes subject to a different privacy policy.

5. Public Listing Information

When your listing is set to "Active," the following information is publicly visible on the Platform and may be indexed by search engines:

Your personal email address and phone number are not displayed publicly. Buyers contact you through the Platform's inquiry form.

Once your listing is marked "Sold" or expires, it is removed from public search results. Previously cached versions may remain in search engines until their cache refreshes.

6. Email Lead Capture

We operate a voluntary lead capture program on parts of our Platform (including a pop-up form and FSBO resource landing pages). If you provide your name, email address, and province through these forms, we store this information in our secure database to:

By submitting a lead capture form, you consent under CASL to receiving commercial electronic messages from OwnerListed. You may unsubscribe at any time by clicking the unsubscribe link in any email we send, or by emailing info@ownerlisted.ca with "Unsubscribe" in the subject line.

We retain lead capture data for up to 2 years from the date of submission, or until you unsubscribe or request deletion, whichever comes first.

7. Analytics & Tracking

Google Analytics 4 (GA4)

We use Google Analytics 4 (Measurement ID: G-3HVM933P2L) to understand how visitors use our Platform. GA4 collects anonymized data including: pages visited, time on page, traffic sources, device type, and geographic region (city level, not precise location). This data is processed by Google LLC, which may store it on servers in the United States.

GA4 data is associated with a unique anonymous identifier (cookie or device signal), not with your name or email address. We have enabled IP anonymization in our GA4 configuration. We use GA4 data exclusively to improve the Platform and understand our audience — we do not use it to build individual user profiles or share it with advertisers.

If you prefer not to be tracked by GA4, you may install the Google Analytics Opt-out Browser Add-on.

No Other Advertising Trackers

We do not use advertising cookies, tracking pixels, Facebook Pixel, or any third-party advertising network trackers on our Platform. We do not display third-party ads on our Platform.

8. Data Retention

We retain your personal information as follows:

You may request deletion of your account and personal data at any time (see Section 10). Note that certain records may be retained to comply with legal obligations even after a deletion request, including CRA record-keeping requirements.

We implement reasonable technical and organizational safeguards to protect your personal information, including:

No method of transmission over the internet is 100% secure. We cannot guarantee absolute security but will notify you promptly if we become aware of a breach affecting your personal information, as required under PIPEDA's breach notification requirements and applicable provincial laws.

10. Your Rights — All Provinces

Under PIPEDA (and substantially similar provincial privacy laws in BC and Alberta), you have the right to:

11. Quebec Residents — Additional Rights Under Law 25

If you are a resident of Quebec, you have the following additional rights under Quebec Law 25 (Act Respecting the Protection of Personal Information in the Private Sector, CQLR c. P-39.1 as amended):

Language of business: OwnerListed will communicate with Quebec residents in French upon request, in compliance with the Charter of the French Language, CQLR c. C-11. Requests may be sent to info@ownerlisted.ca.

Privacy Officer for Quebec: OwnerListed has designated a Privacy Officer as required by Law 25. Contact information is in Section 18.

12. Children's Privacy

The Platform is not directed at persons under 18 years of age (or the applicable age of majority in your province). We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, please contact us at info@ownerlisted.ca and we will delete it promptly.

13. International Data Transfers

OwnerListed is a Canadian company and stores your personal information primarily on servers located in Canada (Hostinger Canada infrastructure). However, some of our service providers (including Stripe and Google) may process your data in the United States or other countries. Where personal information is transferred outside Canada, we ensure appropriate contractual protections are in place, such as standard contractual clauses or reliance on the organization's binding corporate rules.

Quebec residents: OwnerListed has conducted privacy impact assessments for cross-border transfers of personal information as required by Law 25, and applicable contractual safeguards are in place with Stripe and Google.

14. Cookies

We use only the following types of cookies:

We do not use advertising cookies, remarketing cookies, third-party tracking pixels, or cookies to build individual behavioral profiles for advertising purposes. No cookie consent banner is displayed because we use only necessary and analytics cookies — where Law 25 requires more explicit consent mechanisms for Quebec residents, we will implement them as required.

15. CASL — Canada's Anti-Spam Legislation

OwnerListed complies with CASL, SC 2010, c. 23. We send commercial electronic messages (CEMs) only to individuals who have provided express or implied consent under CASL:

Every marketing email we send includes a functioning unsubscribe mechanism. Unsubscribe requests are processed within 10 business days.

Transactional emails (order confirmations, listing activation notices, password resets) are not CEMs under CASL and may be sent without consent while your account is active.

16. Breach Notification

In the event of a data breach that creates a real risk of significant harm to you, OwnerListed will:

"Real risk of significant harm" includes, but is not limited to, bodily harm, humiliation, damage to reputation, financial loss, identity theft, and negative effects on a credit record.

17. Changes to This Policy

We may update this Privacy Policy at any time. We will notify registered users by email at least 14 days before material changes take effect. The current version will always be available at ownerlisted.ca/privacy.php. Continued use of the Platform after the effective date constitutes acceptance of the revised Policy.
