Important legal notice: These Terms are a general framework for OwnerListed as a national FSBO marketing platform. They are not a substitute for legal advice. Real estate law varies significantly by province and territory. OwnerListed strongly recommends you retain a licensed real estate lawyer (or notary in Quebec) in your province before listing or completing a real estate transaction. Nothing in these Terms constitutes legal, tax, financial, or real estate advice.

Plain-language summary: OwnerListed is an online marketing platform — not a real estate agent or brokerage. You list and sell your home yourself. We provide tools, national MLS exposure, and optional support services. You are responsible for your listing, your legally required disclosures, and your transaction. By using our platform you agree to these terms.

1. Who We Are

OwnerListed ("Company," "we," "us," or "our") operates the website at ownerlisted.ca (the "Platform"). We are a Canadian company providing an online marketing platform that allows property owners ("Sellers") to advertise their real property for sale without a licensed real estate agent — a "For Sale By Owner" or FSBO listing.

OwnerListed facilitates MLS® listing access through agreements with licensed real estate brokerages. OwnerListed itself is not a licensed real estate brokerage, real estate agent, mortgage broker, notary, lawyer, financial adviser, or home inspector. MLS® is a registered trademark of The Canadian Real Estate Association (CREA). Listing on MLS® through OwnerListed does not mean you are represented by a real estate agent — you remain a private seller managing your own transaction.

Nothing on this Platform constitutes real estate, legal, financial, tax, investment advice, or a brokerage service as defined under any provincial or territorial real estate services legislation.

2. Acceptance of Terms

By accessing the Platform, creating a seller account, submitting a listing, or purchasing any service, you ("User" or "Seller") agree to be legally bound by these Terms of Service, our Privacy Policy, and any additional policies posted on the Platform. If you do not agree, do not use the Platform.

If you are using the Platform on behalf of a corporation, partnership, estate, or other legal entity, you represent that you have authority to bind that entity to these Terms.

These Terms apply to all users of the Platform regardless of the Canadian province or territory in which the property is located. Where mandatory consumer protection laws of another Canadian province or territory create rights that differ from these Terms, those laws govern for users in that jurisdiction to the extent required by law.

3. Seller Responsibilities

3.1 Accuracy of Listing Information

You are solely responsible for the accuracy, completeness, and lawfulness of all information you submit to the Platform, including: property address, legal description, listing price, square footage, bedrooms and bathrooms, strata or condo fees, property taxes, age of the home, zoning, and any known defects or issues with the property. Misrepresentation of material facts is a civil wrong and may constitute fraud under Canadian law. OwnerListed assumes no liability for inaccurate information submitted by Sellers.

3.2 Mandatory Disclosures

Every Canadian province and territory imposes disclosure obligations on private property sellers. At minimum, you are required to disclose all known material latent defects — defects that are not visible on reasonable inspection but that you know of and that would affect a reasonable buyer's decision or the price they would pay. Failure to disclose a known material latent defect can result in civil liability including rescission of the sale and/or damages. See Section 4 for province-specific requirements.

3.3 FINTRAC Compliance

Real estate transactions in Canada are subject to the Proceeds of Crime (Money Laundering) and Terrorist Financing Act, SC 2000, c. 17 (PCMLTFA). As a private seller, you are responsible for understanding your own FINTRAC obligations. OwnerListed does not perform identity verification on your behalf and is not a "reporting entity" under PCMLTFA in respect of your transaction.

3.4 Professional Advice

We strongly recommend that you retain a licensed real estate lawyer (or notary in Quebec) and, where appropriate, an independent home inspector, appraiser, and accountant before listing or selling your property. A lawyer or notary is required to complete a real estate transaction in Canada regardless of whether an agent is involved. OwnerListed is not a substitute for professional advice.

3.5 Legal Capacity and Authority

You represent that you are at least 18 years of age (or the age of majority in your province), have legal capacity to enter into contracts, and have the legal right to offer the property for sale. This includes, where applicable: spousal consent, co-owner consent, estate authorization (letters probate or letters of administration), power of attorney authority, corporate authorization, or trustee authority.

3.6 Non-Resident Sellers

If you are not a Canadian resident for tax purposes, you may be subject to Canadian withholding tax obligations under the Income Tax Act, RSC 1985, c. 1 (5th Supp.), including Section 116 clearance certificate requirements. Non-resident sellers are responsible for complying with these obligations and notifying the buyer and buyer's lawyer of non-resident status before closing. OwnerListed assumes no liability for non-compliance with non-resident withholding requirements.

4. Province-Specific Disclosure Requirements

The following table summarizes key province-specific disclosure and transaction requirements. This is a general overview only — not legal advice. Always consult a licensed lawyer or notary in your province before proceeding.

Ontario Seller Property Information Sheet (SPIS) optional but creates legal risk if inaccurate — consult your lawyer before completing one. Condominium properties: Status Certificate required. Governed by the Trust in Real Estate Services Act, 2002 (TRESA). Ontario Land Transfer Tax (plus Toronto MLTT) applies. HST may apply to new construction or substantially renovated properties.
Quebec Déclaration du vendeur (Seller's Declaration) is a mandatory written disclosure under the Civil Code of Québec. A notary is mandatory in Quebec real estate transactions. Governed by the Real Estate Brokerage Act, CQLR c. C-73.2. Bienvenue Tax (Welcome Tax) applies. Quebec Law 25 (privacy) and the Consumer Protection Act apply.
New Brunswick Common law disclosure obligations apply. Oil tank and environmental disclosures important. Real Property Transfer Tax (1% of assessed or purchase value) applies. Governed by the Real Estate Agents Act, SNB 1996. Bilingual documentation may be requested.
Nova Scotia Property Condition Disclosure Statement (PCDS) common. Underground oil tank disclosure particularly important. Non-resident ownership surtax may apply. Deed Transfer Tax (DTT) set by municipality (typically 1–1.5%). Governed by the Real Estate Trading Act, RSNS 1989.
Prince Edward Island Property disclosure statement common. The Lands Protection Act, RSPEI 1988, restricts non-resident and corporate land ownership over 5 acres — buyers must confirm eligibility before purchase. Well and septic disclosures required. Real Property Transfer Tax applies. Consult a PEI lawyer before listing.
Newfoundland & Labrador Property disclosure statement common. No provincial land transfer tax. Oil furnace and fuel storage tank disclosure important. Governed by the Real Estate Trading Act, RSNL 1990. Septic and well disclosure required for rural properties.
Yukon Property disclosure common. Land Titles Act applies. Governed by the Real Estate Agents Act, RSY 2002. No territorial land transfer tax. Consult a Yukon lawyer regarding First Nations Settlement Land implications near your property.
Northwest Territories Land Titles Act (NWT) governs land registration. Governed by the Real Estate Agents' Licensing Act, RSNWT 1988. No territorial land transfer tax. Consult a lawyer regarding Indigenous land, zoning, and land use considerations.
Nunavut Land Titles Act (Nunavut) applies. Most land is subject to the Nunavut Land Claims Agreement or Crown land rules. Consult a lawyer regarding fee simple property, Inuit-owned land, and applicable territorial regulations before listing.

5. Our Services

5.1 Platform Role — Not a Brokerage

OwnerListed provides a marketing and listing facilitation platform. Where MLS® listing is included in a package, it is facilitated through a licensed real estate brokerage that holds the MLS® listing on a limited-service basis. The brokerage's role is limited to submitting your listing to MLS® — it does not represent you as a client in a full-service agency relationship. You remain a private seller managing your own transaction.

5.2 Listing Packages

OwnerListed offers listing packages (Basic, Standard, Premium) providing online exposure on ownerlisted.ca and, where included, on MLS® and Realtor.ca. Package features and pricing are described on the Platform at the time of purchase. We reserve the right to modify package features and pricing with reasonable notice.

5.3 Add-on Services

We offer optional add-on services including For Sale signs, open house support agents, professional photography, private showing agents, and offer review consultations. These services are delivered by OwnerListed or by third-party contractors. We make no guarantee of results from any add-on service.

5.4 No Guarantee of Sale

OwnerListed makes no representation or warranty that listing your property on our Platform will result in a sale, or any sale at your asking price. Market conditions, property characteristics, pricing, timing, and other factors entirely outside our control determine sale outcomes.

5.5 Listing Approval and Removal

OwnerListed reserves the right to approve, reject, or remove any listing at our sole discretion, without prior notice, if we determine it violates these Terms, contains inaccurate or misleading information, or is otherwise inappropriate. No refund is owed for listings removed due to Terms violations.

6. Payments, Refunds & Cancellations

6.1 Payment Processing

All payments are processed securely through Stripe, Inc. By completing a purchase, you agree to Stripe's Terms of Service. OwnerListed does not store your credit card information.

6.2 Listing Package Fees

Listing package fees are charged at the time of submission. All listing package fees are non-refundable once your listing has been activated (set to "Active" status), as we begin incurring costs for hosting, promotion, MLS® submission, and administration immediately upon activation. If your listing is rejected before activation, you will receive a full refund within 5–10 business days.

6.3 Add-on Service Fees

Add-on service fees are charged at the time of booking. Add-on services are non-refundable once the service has been scheduled or initiated. Cancellations made at least 48 hours before a scheduled service may be eligible for a credit (not a refund) at OwnerListed's sole discretion.

6.4 Disputes

Any payment disputes must be raised with OwnerListed by email to info@ownerlisted.ca within 30 days of the charge. Initiating a chargeback without first contacting us is a breach of these Terms and may result in account suspension.

7. Taxes on Our Services

All prices shown are before applicable taxes. OwnerListed collects and remits GST/HST under Business Number 791982887RT0001 as required by the Excise Tax Act, RSC 1985, c. E-15, and QST where applicable. The rate depends on your province of residence at time of purchase.

Taxes above apply to OwnerListed's platform service fees only. Provincial land transfer taxes, deed transfer taxes, and real property transfer taxes on your property sale are separate obligations between you and the applicable government authority.

8. Intellectual Property

By submitting listing content (photos, descriptions, floor plans, videos) to the Platform, you grant OwnerListed a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content on the Platform and in marketing materials for the purpose of promoting your listing and OwnerListed's services. You represent that you own or have the right to use all content you submit, including all photos.

All Platform content, branding, code, and design is the property of OwnerListed and may not be copied, reproduced, or used without written permission.

9. Buyer Inquiries and Third Parties

OwnerListed facilitates contact between Sellers and prospective buyers. We do not verify the identity, financial qualification, or intentions of any buyer or buyer's agent. You are solely responsible for vetting buyers, arranging showings safely, and protecting your personal safety and property. We recommend never allowing unaccompanied access to your home and verifying buyer identity before showings.

OwnerListed is not a party to any purchase and sale agreement, offer to purchase, agreement of purchase and sale, or promesse de vente between a Seller and any buyer. We are not responsible for any dispute, loss, or harm arising from buyer-seller negotiations or transactions.

No Agency Relationship — Buyers and Sellers: OwnerListed does not represent, act as agent for, or owe any fiduciary duty to any buyer or seller using this Platform. No employee, contractor, or representative of OwnerListed is acting as a real estate agent on behalf of any user. All transactions on this Platform are private “For Sale By Owner” (FSBO) transactions conducted directly between the seller and the buyer. OwnerListed, its directors, officers, employees, agents, and contractors are not liable for any loss, damage, personal injury, financial loss, or legal liability arising from or in connection with any real estate transaction conducted through or facilitated by this Platform, including but not limited to: failed transactions, misrepresentation by either party, title defects, property condition issues, financing failures, or any other matter relating to the purchase or sale of a property.

Buyers are strongly advised to retain their own independent legal counsel (lawyer or notary), conduct their own due diligence including a professional home inspection, obtain independent financing advice, and review all relevant documents before submitting any offer or completing any purchase. OwnerListed is not responsible for the outcome of any transaction and provides no warranty regarding the condition, title, value, or suitability of any listed property.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OWNERLISTED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF SALE PROCEEDS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR OUR SERVICES.

IN ALL CASES, OWNERLISTED'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO OWNERLISTED IN THE 12 MONTHS PRECEDING THE CLAIM.

Some provinces do not allow limitation of certain warranties or exclusion of certain types of damages. In those provinces, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms limits liability for personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable Canadian law.

11. Indemnification

You agree to indemnify, defend, and hold harmless OwnerListed, its directors, officers, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

OwnerListed does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not warrant that any listing will attract buyers, generate offers, or result in a sale.

Market value estimates, comparable sales data, or neighbourhood information provided on or through the Platform are for informational purposes only and do not constitute an appraisal or professional valuation under any provincial real estate services legislation.

Province-specific guides, checklists, disclosure templates, and blog content on our Platform are for general informational purposes only. They may not reflect the most current legislation or case law in your jurisdiction. Do not rely on them as legal advice.

13. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@ownerlisted.ca if you suspect unauthorized access. OwnerListed is not liable for losses resulting from unauthorized account access caused by your failure to protect your credentials.

You agree not to:

Violation of these prohibitions may result in immediate account termination without refund and may be reported to applicable law enforcement or regulatory authorities.

15. Termination

OwnerListed may suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice. You may delete your account at any time by emailing info@ownerlisted.ca. Upon termination, your listing will be removed from the Platform. Paid fees are non-refundable except as expressly stated in Section 6.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles, except where mandatory consumer protection laws of another Canadian province or territory require that those laws apply for residents of that jurisdiction.

16.1 Informal Resolution

Before commencing any formal dispute process, you agree to email us at info@ownerlisted.ca and give us 30 days to resolve the issue in good faith.

16.2 Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from these Terms or the Platform shall be resolved by binding arbitration in Metro Vancouver, BC, in accordance with the Arbitration Act, SBC 2020, c. 2, before a single arbitrator. The language of arbitration shall be English. The arbitrator's decision shall be final and binding.

16.3 Exceptions

Either party may seek injunctive or equitable relief from a court of competent jurisdiction. Nothing in this section prevents you from making a complaint to a provincial consumer protection office, real estate regulatory body, or the Office of the Privacy Commissioner of Canada.

17. Changes to These Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. The current version will always be available at ownerlisted.ca/terms.php.

18. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and OwnerListed regarding the Platform and supersede all prior agreements.
