Ontario — what you need to know

Every province has different FSBO requirements. OwnerListed handles all of this automatically when you list your Toronto property.

Required disclosures

  • Seller Property Information Statement (SPIS) — strongly recommended, not mandatory, but omitting it can imply misrepresentation
  • FINTRAC identification verification if working with a registered agent
  • Schedule B (Buyer Representation Agreement) if buyers use an agent — you may owe buyer agent commission
  • TRESA (Trust in Real Estate Services Act, 2023) — new multiple offer disclosure rules apply

Seller checklist

  • Decide whether to offer buyer agent commission — most buyers arrive with agents expecting 2–2.5%
  • Complete SPIS — courts treat omissions as misrepresentation even though it's technically optional
  • Under TRESA: you must disclose the number of competing offers in a multiple offer scenario
  • Hire a real estate lawyer for closing — mandatory in Ontario (~$1,500–$2,500)
  • Set aside Ontario Land Transfer Tax: tiered from 0.5% to 2.5% (paid by buyer)
Tax note

Ontario Land Transfer Tax paid by buyer. Toronto adds a second municipal LTT. HST (13%) applies to new construction. No provincial PTT for sellers.

Lawyer / Notary

A real estate lawyer is required for closing in Ontario. Budget ~$1,500–$2,500 including disbursements.

Toronto sellers face both provincial Ontario LTT and the municipal Toronto LTT — buyers need to budget for both. OwnerListed includes Toronto LTT disclosure in your listing and generates SPIS forms and TRESA-compliant multiple offer documentation.
